Terms of Service

1. Agreement and service

These Terms of Service govern a customer's access to and use of LeadToPolicy, a hosted CRM and quote-funnel platform for life-insurance agents and agencies. By ordering, accessing, or using LeadToPolicy, the customer agrees to these terms.

Features depend on the customer's plan tier. Available modules may include an embeddable quote funnel and lead dashboard; a CRM with contacts, pipeline, appointments and booking, email follow-ups, and a secure client portal; business phone and SMS through Telnyx; and AI-assisted call transcription, summaries, follow-up drafts, and lead intelligence.

2. Subscription, pricing, and setup fees

Subscriptions are billed monthly, with an annual billing option. Prices are shown on the LeadToPolicy rate card page and are subject to the customer's order. A one-time setup fee applies only to phone tiers and covers A2P registration and phone-number porting labor.

3. Customer data and isolated instances

The customer is the data controller for personal information belonging to its leads and clients. LeadToPolicy processes that information on the customer's behalf to provide the service. Each customer operates on an isolated instance with a separate application container and separate database.

Customer data may include contact details; quote-request answers, including date of birth, health information, and coverage information a lead chooses to submit; call recordings and transcripts; SMS and email content; appointment details; and browsing or page-visit data on the customer's quote forms. Our handling of personal information is described further in the Privacy Policy.

4. Phone and SMS responsibilities

Customers on phone tiers receive their own phone numbers through the Telnyx carrier platform. The customer must register and maintain its own A2P/10DLC campaign. Phone numbers are portable out.

The customer is solely responsible for its messages and calls and for compliance with all telemarketing, Telephone Consumer Protection Act, and do-not-call requirements that apply to them. This includes obtaining and documenting any required consent before sending messages or making calls. The customer must not use LeadToPolicy to send spam.

5. Insurance and recording compliance

The customer is solely responsible for complying with insurance-licensing requirements that apply to its business and activities. The customer is also responsible for determining and obtaining any consent required to record calls in the jurisdictions of its leads and clients.

6. Acceptable use

The customer may not use LeadToPolicy for unlawful activity. The customer must not use the service to send spam or to place calls or send messages without the consent required by applicable law. Use of LeadToPolicy does not transfer the customer's legal, licensing, telemarketing, or consent obligations to LeadToPolicy.

7. AI features

AI features run against an API key that the customer supplies for the customer's own AI provider account, such as an OpenAI account. LeadToPolicy does not send the customer's data to AI providers under LeadToPolicy's own keys.

8. Availability and service standard

LeadToPolicy is provided "as is." We use reasonable efforts to make the service available, but no uptime service-level agreement is promised at this tier. Interruptions may occur, and the service may not always be available.

9. Non-payment and suspension

We may suspend the service for non-payment. During a non-payment suspension, the customer's embeds serve a graceful unavailable notice and the CRM becomes read-only. The customer can continue to export its data. LeadToPolicy never withholds customer data.

10. Termination, retention, and exit

Either the customer or LeadToPolicy may terminate the service. Customer data is retained while the subscription is active. After cancellation, it remains available for 30 days and is then deleted.

The customer may export its data at any time, including during a suspension and during the 30-day period after cancellation. Customers using a phone tier may port their phone numbers out.

11. Limitation of liability

To the extent permitted by applicable law, LeadToPolicy's total liability arising out of or related to the service or these terms will not exceed the fees the customer paid to LeadToPolicy during the 12 months before the event giving rise to the claim.

12. Governing law

These terms are governed by the laws of the State of Maryland, USA.

13. Changes to these terms

We may change these terms by posting the revised terms on this page and updating the date above. We will notify customers by email of material changes.
